1. Agreement to Terms

By accessing and using RenoRadar (the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to abide by the above, please do not use this service. RenoRadar Pty Ltd ("RenoRadar", "we", "us") reserves the right to update and change these Terms at any time.

2. Description of Service

RenoRadar is a Software-as-a-Service (SaaS) platform designed to monitor and alert users about Development Applications (DAs) lodged with local planning authorities in New South Wales, Australia. Our Service includes:

  • Real-time monitoring and alerts for Development Applications (DAs) from NSW Planning Portal
  • Email notifications for saved DA searches and custom alerts
  • Saved searches and monitoring configurations
  • CSV export functionality for DA data
  • Contact enrichment and integration capabilities
  • CRM platform integrations

3. Account Registration

To use RenoRadar, you must register for an account and provide accurate, current, and complete information. You must:

  • Be at least 18 years of age
  • Provide accurate information during registration
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Register only one account per person or entity

You are responsible for maintaining the security of your login credentials. RenoRadar is not liable for any unauthorized access resulting from your failure to protect your credentials.

4. Subscription Plans & Pricing

4.1. Available Plans

RenoRadar offers the following subscription tiers (all prices in Australian Dollars and inclusive of Goods and Services Tax):

  • Starter: $99.00 per month - Basic DA monitoring, saved searches, and email alerts
  • Pro: $249.00 per month - Enhanced features including CSV exports and contact enrichment
  • Team: $499.00+ per month - Advanced features including CRM integrations and team collaboration

4.2. Free Trial

New users are eligible for a 14-day free trial of the Starter plan. Access to the free trial does not require a payment method. Following the free trial period, you must select a paid subscription plan to continue using the Service.

4.3. Price Changes

RenoRadar reserves the right to change subscription prices with 30 days' notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing. Current subscribers will not experience price increases until their next renewal period.

5. Payment Terms

5.1. Billing Cycle

Subscription fees are billed monthly in advance. Your subscription automatically renews on the same date each month unless you cancel.

5.2. Payment Processing

Payments are processed via Stripe. RenoRadar does not store your payment information directly. By providing your payment details, you authorize RenoRadar to charge your account monthly.

5.3. Failed Payments

If a payment fails, RenoRadar will attempt to recharge your account up to three (3) times over a period of 5 business days. If payment ultimately fails after three retry attempts, your account will be suspended until payment is received. You remain responsible for all fees incurred while your account is active.

5.4. Refund Policy

Refunds are issued only as follows:

  • Monthly subscriptions: No refunds are issued. Subscriptions are non-refundable.
  • Annual subscriptions: Pro-rata refunds are available if you cancel within 14 days of purchase.
  • Free trial: No refund applies as there is no charge during the trial period.

6. Fair Use Policy

6.1. API Rate Limits

Users must respect API rate limits as defined for their subscription tier. Excessive usage or attempts to circumvent rate limiting may result in account suspension.

6.2. Export Limits

CSV export functionality is subject to the following limits per subscription tier:

  • Starter: 100 records per export, maximum 5 exports per day
  • Pro: 1,000 records per export, maximum 20 exports per day
  • Team: Unlimited exports

6.3. Prohibited Conduct

Users must not:

  • Scrape, copy, or extract DA data from RenoRadar for resale or unauthorized distribution
  • Resell RenoRadar data or services without explicit written permission
  • Use RenoRadar data for automated mass outreach, spamming, or harassment
  • Use the Service to conduct illegal activities or violate any applicable laws
  • Attempt to reverse engineer, decompile, or access the underlying source code

7. Data & Accuracy Disclaimer

Development Application data provided by RenoRadar is sourced from the NSW Planning Portal, which is publicly available data licensed under Creative Commons Attribution 4.0 International (CC BY 4.0).

7.1. No Accuracy Guarantee

RenoRadar does not guarantee the accuracy, completeness, or timeliness of DA information provided through the Service. While we strive to keep data current, delays may occur between lodgement and appearance in our system. Users must independently verify all information before relying on it for business decisions.

7.2. Not Professional Advice

RenoRadar is a data monitoring tool and not a substitute for professional advice. Users should consult with appropriate professionals (engineers, architects, planning consultants, legal advisors) before making decisions based on DA information.

7.3. User Responsibility

You acknowledge that you are solely responsible for evaluating the suitability and accuracy of the information provided and for ensuring that your use of the Service complies with all applicable laws and regulations.

8. Intellectual Property

8.1. RenoRadar's Rights

RenoRadar Pty Ltd retains all intellectual property rights in the Service, including but not limited to:

  • The RenoRadar platform and user interface
  • All proprietary scoring algorithms and data analysis tools
  • Design, layout, and functionality of the Service
  • Any custom reports or analytics generated by the Service

8.2. Source Data Licensing

Development Application source data is provided by NSW Government under the Creative Commons Attribution 4.0 International License (CC BY 4.0). Users may use this data in accordance with CC BY 4.0 terms, which require attribution to NSW Government.

8.3. User-Generated Content

You retain ownership of your saved searches, custom alerts, and configurations. RenoRadar may use aggregated, non-identifying information from user activity to improve our Service.

9. Acceptable Use

You agree not to use RenoRadar for:

  • Any illegal purpose or in violation of any applicable laws or regulations
  • Spamming, harassing, or contacting individuals found via the Service without consent
  • Violating the Spam Act 2003 (Commonwealth) or similar legislation in other jurisdictions
  • Reverse engineering, decompiling, or attempting to derive the source code of the Service
  • Circumventing security features or access controls
  • Interfering with the operation or availability of the Service
  • Transmitting viruses, malware, or other harmful code

10. Privacy

Your use of RenoRadar is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using the Service, you consent to the terms of our Privacy Policy.

11. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable laws:

  • RenoRadar's total liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim.
  • RenoRadar is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, or lost data, even if RenoRadar has been advised of the possibility of such damages.
  • Nothing in these Terms excludes or limits any guarantees, representations, or conditions implied by the Australian Consumer Law or other legislation that cannot be excluded or limited.

12. Indemnification

You agree to indemnify, defend, and hold harmless RenoRadar Pty Ltd, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your breach of these Terms of Service
  • Your misuse of the Service or RenoRadar data
  • Your violation of any applicable laws or third-party rights
  • Your use of RenoRadar data in violation of the Spam Act 2003 or similar legislation

13. Suspension & Termination

13.1. Suspension for Breach

RenoRadar may suspend your account immediately if you breach these Terms, engage in fraudulent activity, or violate applicable law. Suspension will be preceded by notice whenever reasonably practicable, except in cases of serious abuse.

13.2. User Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No refund is issued for the current billing period.

13.3. Data Export & Deletion

Upon termination or cancellation, you may export your data (saved searches and configurations) for 30 days. After 30 days, your data will be permanently deleted from our systems. RenoRadar is not liable for any data loss following the 30-day export window.

14. Changes to Terms

RenoRadar may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the Service following the notice period constitutes acceptance of the modified Terms. If you do not agree to the changes, you must cancel your account.

15. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other documents expressly referenced herein, constitute the entire agreement between you and RenoRadar regarding the use of the Service and supersede all prior negotiations, understandings, and agreements, whether written or oral.
